Is Marijuana Legal In Ohio?

For many years, marijuana has been decriminalized throughout the state of Ohio. However, recent measures by Ohio lawmakers have paved the way for medical marijuana to become readily available throughout the state.

 

Ohio House Bill 523 was signed into law by Governor John Kasich on September 8, 2016. The first medical marijuana dispensary in Ohio opened their doors to patients on January 16, 2019. Ohio now has 45 total dispensaries with certificates of operations, with a total of 11 other Ohio dispensaries still readying to begin operations. The operational dispensaries currently have flower, tinctures, edibles, and concentrated oils available for purchase, with expectations to have topicals introduced to the market within the year.

Will My Current Doctor Know I Have An Ohio Medical Marijuana Card?

Ohio requires doctors to have documented evidence of your qualifying medical condition before issuing recommendations, which means that your medical records are necessary in order to receive a medical marijuana card. However, the medical marijuana recommendation does not come from your current primary care physician. Rather, one of the state-certified medical marijuana doctors will examine you in their office, and cross-reference your medical conditions before recommending medical marijuana.

Will my name be a list of marijuana users?

 

The State of Ohio Board of Pharmacy requires that your recommendation for medical marijuana be kept on file. This allows the state to keep track of medical marijuana users throughout every county. That said, this information is kept private, and is on file in the event a patient must prove that he or she is a registered medical marijuana user. Having a medical marijuana card, however, does not protect patients from employers, who may still require drug testing for employment.
