Ohio's marijuana industry continues to evolve at both the state and local levels. The latest change comes from Shaker Heights, where city officials have approved new zoning regulations governing where marijuana dispensaries can operate and the standards they must follow.

The new rules classify marijuana dispensaries as conditional uses in Shaker Heights' commercial zoning districts, meaning a dispensary will need additional local review before opening. The regulations also establish requirements involving location, operating hours, security, storefront design and more.

For Ohio medical marijuana patients, the changes are another example of how individual communities are preparing for a growing marijuana market while determining how dispensaries fit into their neighborhoods.

Here's what Ohio marijuana patients should know about the new Shaker Heights dispensary rules and what they could mean for marijuana access in the Cleveland area.

What Changed for Marijuana Dispensaries in Shaker Heights?

Shaker Heights City Council considered Ordinance No. 26-65, which changes the city's zoning code to establish specific regulations for marijuana dispensaries.

Previously, dispensaries were generally treated as retail uses under the city's zoning rules. Under the new approach, marijuana dispensaries are classified as conditional uses in commercially zoned districts. This is an important distinction.

A conditional use isn't automatically permitted simply because a business wants to open in a commercial district. Instead, a proposed marijuana dispensary must go through the city's conditional-use approval process. That process includes review by the Shaker Heights City Planning Commission along with confirmation from City Council.

The goal is to allow marijuana dispensaries while giving the city greater oversight of where they operate and how individual locations are designed.

What Are the New Shaker Heights Marijuana Dispensary Rules?

The regulations establish several requirements that marijuana dispensary operators must meet.

Under the new standards, a dispensary must:

• Hold the appropriate marijuana dispensary license from the State of Ohio

• Submit a safety and security plan

• Design the location to minimize impacts on surrounding properties

• Prevent marijuana-related activities inside the dispensary from being visible to the public

• Maintain clear front windows rather than blocking or tinting them

• Operate without a drive-through

• Remain at least 500 feet away from certain sensitive uses

• Remain at least one mile from another marijuana dispensary

• Operate only between 7 a.m. and 9 p.m.

• Maintain its state marijuana license to keep its local conditional-use approval

The city defines sensitive uses to include schools, parks, playgrounds, libraries, child day care centers and places of worship.

Some of these requirements overlap with existing Ohio marijuana regulations, while others add local restrictions. For example, Shaker Heights officials noted that the city's proposed regulations tighten allowable operating hours, prohibit drive-throughs and establish requirements for clear front windows.

Why Did Shaker Heights Adopt New Marijuana Rules?

Ohio's marijuana landscape has changed considerably since voters approved adult-use marijuana in November 2023.

Shaker Heights did not simply ban marijuana dispensaries. Instead, city officials chose to establish additional regulations for dispensaries that want to operate within the city. City planning staff explained that marijuana dispensaries are already subject to extensive state licensing and regulation. The local rules are designed to work alongside those requirements while addressing the potential impact of dispensaries on surrounding neighborhoods and businesses.

The Shaker Heights City Planning Commission reviewed the proposed changes during a July 7, 2026 public hearing and recommended approval. The ordinance then moved through the required City Council process, including readings on July 13 and July 27 and a third reading and public hearing on August 10.

How Close Can a Marijuana Dispensary Be to a School in Shaker Heights?

Under the city's rules, a marijuana dispensary cannot be located within 500 feet of a sensitive use.

That includes:

• Schools

• Parks

• Playgrounds

• Libraries

• Child day care centers

• Places of worship

Location restrictions are particularly significant in Shaker Heights because the community has numerous schools, parks and other sensitive-use properties.

Earlier in 2026, city officials noted that existing state distance requirements already limited the number of locations where a marijuana dispensary could potentially operate in Shaker Heights. The new conditional-use process gives the city another layer of review before a marijuana dispensary can open at an eligible location.

Why Is There a One-Mile Rule for Marijuana Dispensaries?

The new regulations also require a marijuana dispensary to be at least one mile away from another dispensary. This restriction limits how closely marijuana businesses can cluster within Shaker Heights.

For prospective dispensary operators, that means finding a location involves more than identifying available commercial property. A potential site must satisfy both the city's sensitive-use restrictions and its separation requirement from other dispensaries.

For patients, these restrictions could affect where future marijuana dispensaries are ultimately able to open.

Shaker Heights Marijuana Dispensaries Cannot Have Drive-Throughs

Another notable part of the new rules is a prohibition on drive-through marijuana dispensaries. A dispensary approved in Shaker Heights will need to operate as a traditional storefront rather than offering marijuana purchases through a drive-through window.

The city is also requiring storefronts to maintain clear windows. Windows cannot be blocked or tinted, although marijuana products and marijuana-related activity inside the facility must still comply with rules limiting public visibility.

These regulations are intended to balance state marijuana requirements with Shaker Heights' standards for commercial properties and neighborhood development.

Marijuana Dispensary Hours Will Be Limited

Shaker Heights is also placing limits on when marijuana dispensaries can operate. Under the regulations, dispensaries may not operate between 9 p.m. and 7 a.m.

That means marijuana dispensaries in the city will generally be limited to operating between 7 a.m. and 9 p.m., even if broader state regulations would otherwise permit different hours. Local operating-hour restrictions are one example of how marijuana rules can vary depending on where you are in Ohio.

Patients should always check the current hours of a specific dispensary before visiting.

What Do the New Rules Mean for Ohio Medical Marijuana Patients?

For existing medical marijuana patients, the Shaker Heights changes do not alter the fundamental requirements of Ohio's medical marijuana program.

Instead, the new rules primarily regulate marijuana dispensary businesses and where they can operate within Shaker Heights.

However, local dispensary regulations can still matter to patients because they influence where marijuana businesses are located and how convenient it is for patients to access them. As more communities address marijuana dispensary zoning, Ohio patients could see the number and location of marijuana dispensaries continue to change.

Patients are not limited to purchasing medical marijuana in the city where they live. Eligible medical marijuana patients can visit licensed dispensaries throughout Ohio, subject to the rules of the state's marijuana program.

Medical Marijuana vs. Adult-Use Marijuana in Ohio

Ohio now has both medical and adult-use marijuana, but the two systems aren't necessarily identical for consumers.

Adults 21 and older can legally purchase adult-use marijuana from licensed dispensaries. However, patients who use marijuana to manage a qualifying medical condition may still find value in maintaining their medical marijuana status.

Registered medical marijuana patients have access to benefits such as medical-specific dispensary promotions or discounts at participating dispensaries, not having to pay the 10% excise tax, and other advantages associated with Ohio's medical marijuana program.

Can Shaker Heights Have Medical and Recreational Marijuana Dispensaries?

The Shaker Heights zoning code defines a marijuana dispensary as a facility licensed by the State of Ohio to sell or dispense medical and/or adult-use marijuana in accordance with state law. That means the city's regulations aren't limited to one side of Ohio's marijuana market.

A licensed dispensary selling medical marijuana, adult-use marijuana or both would be subject to the applicable Shaker Heights zoning requirements.

Importantly, the city's decision is not an approval for a specific dispensary to open. A marijuana business would still need the appropriate state licensing and would have to satisfy Shaker Heights' conditional-use approval process and other applicable requirements.

The Shaker Heights decision highlights an important part of marijuana legalization in Ohio: state law is only part of the picture.
